The O-1 Visa is a temporary work visa for individuals with extraordinary abilities who intend to use their talents in the U.S. for a specific period. The applicant must have achieved significant success in their field and be able to provide documentation of these achievements.

📄 Application Process

The O-1 Visa application process is initiated by the employer or representative of the applicant, who will submit Form I-129 to USCIS (U.S. Citizenship and Immigration Services). This form includes details about the position the applicant will work in and the job specifics.

The next step involves the applicant completing the online DS-160 form provided by the U.S. Department of State. This form includes personal information and the purpose of the trip.

The applicant will attend an interview at the U.S. consulate. If the interview is successful, the immigrant visa is approved. Once the applicant enters the U.S., they can begin working under the O-1 visa. The O-1 visa is initially granted for 3 years and may be extended if the conditions remain unchanged.

Required documents for the O-1 Visa application include a copy of the applicant's passport, biometric photograph, DS-160 form, and I-129S Petition. Additionally, documents that prove the applicant’s extraordinary abilities and achievements, business plans, financial records, and company activity documents are requested.

📄 Family Members

The spouse and unmarried children under 21 years old of the O-1 visa holder can join them in the U.S. with an O-3 visa. Family members are allowed to stay in the U.S. for the same duration as the primary applicant. However, O-3 visa holders may only attend school in the U.S. and are not authorized to work.
